Special music will be featured. Everyone is wel- come to attend. DeWIIT’S EXCLUSION OF JAPANESE UPHELD BY US CIRCUIT COURT SAN FRANCISCO, Dec. 2- The constitutionality of Lieut.Gen.John L. DeWitt’s evacuation orders for all persons of Japanese ances- try from West coast military areas was upheld by the Ninth Federal Circuit Court of Appeals in a case rati- fied by the Supreme Court, according to the New York Times. The decision, written by Judge Curtis D. Wilbur, was signed by four other Western judges. That General DeWitt’s orders had exceeded “the area of discretionary powers legally to be excercised by him in Military Are No.1” were not denied by Judge William Denman. How- ever, DeWitt devoted much attention to hardships sus- tained by Japanese Ameri- cans not only through their being evacuated but by being kept in detention, and he expressed the hope that the evacuees might be compensated,stated Denman. Judge Wilbur declared that the Supreme Court had upheld the validity of West Coast “curfew hours” a- gainst the Japanese in two known cases. He added that the Government in prosecut- ing a war has the power to do everything necessary even if the powers it as- sumes temporarily infringe on some guaranteed liber- ties of individuals. On the other hand,Judge Stephens elaborated that "there is no sanction in o u r governmental scheme for the courts to...take unto themselves the power to vise the acts of Congress and the President upon war matters so long as such acts are not in conflict with the provisions of the Constitution itself."
