He is survived by his parents; three brothers, T/ogt, Ha z uma, somewhere in the South Pacific, Cpl. Walter,previously reported seriously wounded in France, and Pvt.Calvin, now training at Fort SneiTing,Minn., and three sisters, Mrs* Edith Chikuda of this center, Mrs. Gladys Inouye and Mrs. Susie Fuiioka of Denver, and Mrs.Taki Okusu of Salt Lake city. Part of Lieut, Gen. <Iacob L, Devers' Sixth Army Group,, the 442nd•s o-annon company is participating in a tough, mountain warfare by covering advancing patrols and disorganizing enemy attempts to attack strategic outposts. It has given constant support to Japanese American infantrymen'spearheading the Seventh Army's firive toward Germany. Several-nisei have returned to the Hood" River '■CI onFmrnmiSiiEu The conviction of 63 nisei in the US district court in Wyoming for refusing to report ilor induction into military service was upheld by the Tenth US circuit court of appeals in Denver last Monday, Judge T. Blake Kennedy sentenced them to serve three years in the penitentiary. The decision was handed down in the case of Shigeru Fuji:! and it has been stipulated by both sides that the opinion in this case would apply to all the others. Fujii,although resenting the fact that he- had been put in the ' Heart Mountain relocation center,Insisted that he was loyal to the United States and wanted to serve this country,provided' it respected his rights, "Two wrongs do not make a right,"said Judge Halter A. Huxman, who wrote the circuit court of appeals opinion. .Since Fujii disobeyed a law of the United States, he must pay the penalty, ' Judge Huxman added. area, however, despite American Legion advertisements urging them not to come bad:.
